Summary:

This Act establishes a TFN Traditional Territory Boundary Commission. The Commission will be made up of the Chief and two other Members at least one of whom must be knowledgeable about natural resource managing and harvesting.

The commission will be responsible for overlap and related issues arising from boundaries set out in the TFN Treaty.  It will provide a forum for TFN and neighbouring first nations to address natural resource harvesting issues and to find a consensus based solution to problems of mutual concern.

The members of the commission are required to respect and honour the traditions and practices of neighbouring First Nations, and to do their utmost to develop and maintain relationships with them based on the rights and traditions of each.

The commission may negotiate and attempt to reach agreement on shared harvesting rights with other First Nations within areas of Tsawwassen’s exclusive right to harvest and on issues related to Tsawwassen First Nation traditional territory boundaries in order to achieve reconciliation on matters relating to natural resource harvesting.  It can establish mediation if that will help resolve issues.
