The Election Act sets out the process by which future TFN elections will be conducted. After Effective Date, eligible voters will be Tsawwassen Members--which means those Tsawwassen individuals who have enrolled under the Final Agreement (and who are at least 18 years old).
The Act provides for the election of a Chief and the new 12-member Legislature and sets out the foundational processes for voting as well as the terms of office and the requirements and terms for running for office including:
- Calling the election
- Candidate eligibility
- voters list
- nomination meetings
- campaign advertising
- ballots, including mail-in votes
- notice of election
- voting day
- counting of ballots
- appeals
- responsibilities of election officers
- disqualification of Chief or Legislator
Much of these processes follow standard procedures as set out in the old TFN Election Code though the detailed, step by step processes will be set out in regulations. In some cases there have been changes made to old election processes including:
- mail in ballots will now have to be sent to all Tsawwassen Members, on and off reserve.
- possible disqualification or reductions in pay of Chief, Legislators and Executive Council members for too many missed meetings
- Executive Council may set a different election date, as long as the term lasts less than 2 1/2 years and no more than 3 years.
- The ability to enforce penalties for election offenses, up to $10,000 fine or seven year ban on running for office
The first Elections will be held no later than six months after effective date.
